Legal Advice and Services:

Legal Advice: Provides written and oral legal advice to clients regarding response and recovery operations to comply with federal grant program requirements and other applicable federal law. This may also include representation on federal program appeals, arbitrations, federal statutory and regulatory compliance, and risk mitigation.

Drafting/Reviewing Federal Grant Requests/Correspondence: Preparation or review of federal grant requests, policies and procedures to ensure legality, enforceability, and compliance with applicable federal laws.

Attendance at Meetings: Attendance at regular and special meetings as requested, providing legal counsel during discussions with federal and other emergency management partners.

Contracts and Agreements: Reviewing all grant contracts for compliance with federal laws, including 2 C.F.R. Part 200, preparing intergovernmental agreements, legal responsibility reviews, procurement document reviews for federal compliance, disaster recovery center documents, and Memorandums of Understanding or Agreement.

Coordination with Outside Counsel: If specialized legal representation is required (e.g., environmental, tax, or complex litigation), we will coordinate and manage outside counsel as needed, ensuring cost-effectiveness and alignment with the client's goals.

Public Assistance (PA) Specialty Services:

PA Project Formulation and Documentation: Advising clients during the project formulation phase of legal requirements, documentation requirements, potential liabilities, defenses, and legal strategies to maximize federal grant reimbursement.

Public Assistance Procurement Under Grants: Advising clients on federal procurement requirements and compliance prior to and after contract award.

Policy Development: Advising and assisting in the formulation or revision of internal policy documents and procedures to ensure consistency with federal legal requirements to maximize the potential for grant reimbursement.

Appeals/Arbitrations: Represent clients at Public Assistance appeals and arbitrations.

Ethics, Compliance, and Training:

Ethics Guidance: Interpretation and enforcement of federal ethics requirements (if applicable), and federal conflict of interest rules.

Compliance Oversight: Ongoing monitoring of situational legal developments affecting client operations and impacts to federal reimbursement.

Training Workshops: Conduct legal training for clients on federal topics such as Privacy Act compliance, federal records requirements, procurement under federal grants, and federal liability risks.
